Certain brand, model, or supplier information may be provided directly during the inquiry or quotation process rather than displayed publicly on the website.

4. Pricing, “Wholesale” Claims & Promotions

References to wholesale pricing describe WCW's direct-sales business model and do not guarantee that a quoted price will be lower than every price available from every other seller at every time.

Unless a written quote states otherwise, website pricing or promotional references may exclude applicable taxes, delivery, placement, setup, electrical work, site preparation, permits, cranes or specialized equipment, accessories, upgrades, or other project-specific costs.

Promotions, including any advertised $500-off offer, are subject to the eligibility rules, dates, product availability, exclusions, and other conditions communicated with the promotion or in the written quote. Promotions have no cash value unless expressly stated otherwise and may not be combined with other offers unless WCW confirms this in writing.

5. Quotes, Orders & Contract Formation

Submitting a form, requesting information, registering for a promotion, or discussing a product does not obligate you to purchase and does not obligate WCW to sell a particular product.

A transaction becomes binding only when the parties complete the applicable sales process and WCW issues or accepts the required written documentation, such as a quote, order confirmation, invoice, or sales agreement, together with any required deposit or payment.

If the terms of a transaction document conflict with these website Terms & Conditions, the transaction document controls for that transaction, subject always to applicable law.

6. Payments, Deposits, Changes, Cancellations & Refunds

Payment schedules, deposits, accepted payment methods, cancellation rights, change-order costs, return eligibility, and refunds are governed by the written terms provided for the applicable transaction and by applicable law.

Special-order, customized, installed, used, or otherwise non-resalable items may be subject to different cancellation or return conditions where permitted by law.

7. Delivery, Setup & Site Readiness

Delivery and setup availability depends on location, access, product size, weather, carrier or contractor availability, and site conditions. Estimated dates are not guaranteed unless expressly stated in a written agreement.

Unless WCW agrees otherwise in writing, the customer is responsible for ensuring that the site is suitable and accessible for delivery and installation, including any required base or foundation, clearances, structural support, electrical service, plumbing or drainage, permits, access route, gate width, crane access, and compliance with applicable codes or property rules.

Additional charges may apply where actual site conditions differ materially from the information provided to WCW or require extra labour, equipment, return trips, storage, redelivery, or third-party services.

8. Manufacturer Warranties & After-Sales Service

Products may be covered by manufacturer or distributor warranties. The scope, duration, exclusions, claim process, labour coverage, travel charges, and parts coverage are governed by the applicable warranty documentation.

WCW may assist customers with warranty or service coordination, but website statements do not expand or replace the written manufacturer warranty unless WCW expressly provides a separate written warranty.

Statutory warranties and consumer rights that apply by law are not excluded by this section.

9. Health, Hydrotherapy & Safety Information

References to relaxation, recovery, exercise, hydrotherapy, or wellness are general product-use descriptions and are not medical advice or a promise to treat, cure, prevent, or diagnose a medical condition.

Follow the manufacturer's safety instructions and consult an appropriate healthcare professional if you have a medical condition, are pregnant, take medication, or have concerns about heat exposure, aquatic exercise, or spa use.

10. Acceptable Website Use

You agree not to:

• use the website for unlawful, fraudulent, abusive, or misleading purposes;

These website Terms & Conditions are governed by the laws of Manitoba and the applicable federal laws of Canada, without limiting any mandatory consumer protection rights that apply to you based on the circumstances of a transaction.

WCW may update these Terms & Conditions from time to time. Changes apply prospectively from the date the revised Terms are posted and do not retroactively change an already completed sales agreement unless the parties agree or the law requires otherwise.
